1. Introduction & Acceptance

Welcome to Academic Group. These Terms and Conditions ("Terms") govern your access to and use of our website, courses, books, digital products, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

Academic Group is operated by Academic Group Pty Ltd (ABN: XX XXX XXX XXX), a company registered in Western Australia, Australia.


2. Definitions

"We," "Us," "Our" refers to Academic Group Pty Ltd

"You," "Your," "User" refers to the person or entity using our Services

"Student" refers to the enrolled participant in our courses

"Parent/Guardian" refers to the legal guardian of a student under 18 years

"Content" refers to all text, images, videos, materials, and resources provided through our Services

"Account" refers to the user profile created to access our Services


3. Account Registration & Use

3.1 Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to create an account (parental consent required if under 18)
  • One person may not maintain multiple accounts

3.2 Account Security

  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • We are not liable for any loss or damage arising from your failure to protect your account

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account has been inactive for more than 24 months
  • We determine termination is necessary for security or legal reasons

4. Course Enrollment & Attendance

4.1 Enrollment Requirements

  • Course availability is subject to minimum and maximum enrollment numbers
  • We reserve the right to cancel courses that don't meet minimum enrollment
  • Age and year level requirements must be met for specific courses
  • Prerequisites must be satisfied where indicated

4.2 Course Changes

  • We reserve the right to modify course content, schedules, or instructors as needed
  • If significant changes occur, enrolled students will be notified in advance
  • In the event of course cancellation by us, you will receive a full refund or credit

4.3 Student Conduct

Students are expected to:

  • Treat teachers, staff, and fellow students with respect
  • Arrive on time and attend all scheduled classes
  • Complete assigned work and participate actively
  • Follow all campus rules and safety guidelines
  • Not disrupt or interfere with the learning environment

Warning: Violation of conduct expectations may result in removal from the course without refund.


5. Payment Terms

5.1 Pricing

  • All prices are in Australian Dollars (AUD) and include GST where applicable
  • Prices are subject to change without notice
  • The price charged will be the price displayed at the time of purchase

5.2 Payment Methods

We accept:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • Direct debit / bank transfer
  • PayPal
  • Purchase orders (for schools and organizations)
  • Payment plans (3 installments available for courses over $500)

5.3 Payment Plans

  • Payment plans divide the total cost into 3 equal installments
  • First installment is due at enrollment
  • Subsequent payments are automatically charged every 30 days
  • Missed payments may result in suspension of access until payment is received
  • Refund policy applies based on when cancellation occurs, not payment completion status

5.4 Failed Payments

If a payment fails, we will notify you and attempt to process payment again. Continued failed payments may result in:

  • Suspension of access to digital services
  • Removal from course enrollment
  • Referral to collections (for outstanding balances over $100)

6. Intellectual Property Rights

6.1 Our Content

All content, materials, resources, and intellectual property provided through our Services are owned by Academic Group or our licensors and are protected by Australian and international copyright laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and use course materials for personal educational purposes only
  • Download materials for offline study (where explicitly permitted)
  • Print materials for your own use

6.3 Prohibited Uses

You may NOT:

  • Copy, reproduce, or distribute our materials to third parties
  • Sell, rent, or sublicense our content
  • Modify, adapt, or create derivative works
  • Remove copyright notices or watermarks
  • Share account credentials or course access with others
  • Use our materials for commercial purposes
  • Reverse engineer or extract source code

7. Privacy & Data Protection

We take your privacy seriously. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you consent to our collection and use of personal information as outlined in our Privacy Policy.

For students under 18, parents/guardians consent to the collection of their child's information for educational purposes.


8. Limitation of Liability

8.1 Educational Services

Our courses and materials are designed to support student learning. However:

  • We do not guarantee specific academic outcomes or exam results
  • Student success depends on individual effort, aptitude, and circumstances
  • We are not responsible for school admission decisions or ATAR scores

8.2 Service Availability

  • We strive for 99.9% uptime but cannot guarantee uninterrupted access
  • Planned maintenance may cause temporary service interruptions
  • We are not liable for damages caused by service outages

8.3 Third-Party Links

Our Services may contain links to third-party websites or resources. We are not responsible for:

  • The content, accuracy, or practices of third-party sites
  • Any damages or losses caused by third-party services

8.4 Maximum Liability

To the maximum extent permitted by law, our total liability for any claims arising from your use of our Services shall not exceed the amount you paid to us in the 12 months preceding the claim.


9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Your violation of any third-party rights
  • Any content you submit or share through our Services

11. Governing Law & Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You submit to the exclusive jurisdiction of the courts of Western Australia.

11.2 Dispute Resolution

If a dispute arises:

  1. Contact us first to attempt informal resolution
  2. If unresolved, either party may refer the matter to mediation
  3. If mediation fails, disputes may be brought to court

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date at the top of this page
  • For material changes, we will notify you via email or prominent notice on our website
  • Your continued use of our Services after changes constitutes acceptance
  • If you don't agree to the new terms, you must stop using our Services

13. General Provisions

These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Academic Group.

13.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

13.4 Assignment

You may not assign or transfer these Terms or your account. We may assign our rights without restriction.
